Information on Posting Discipline Summaries on the Institute's Website
In the public interest and for the educational benefit of members and students, the following discipline summaries are posted on the Institute's website:
- Professional Conduct Enquiry Committee Determinations and Recommendations;
- Resolutions of Discipline Proceedings (referred to prior to December 31, 2007 as “Resignations in the Face of Discipline”);
- Discipline Tribunal Decisions;
- Council Appeal Tribunal Decisions (eliminated March 24, 2004); and
- Other Public Notices.
General guidelines have been developed with regard to posting discipline summaries on the website after January 1, 2008:
- PCEC determinations and recommendations that have been accepted by members will generally be kept on the members’ only section of the website indefinitely. The anonymity of members is maintained in this process. Since June 20, 2012, where the member has agreed to the publication on the publically accessible section of the Institute’s website of a notice concerning the member’s determination and recommendation it will generally be kept on the website for a period of two years after which it will be placed on the members’ only section of the website which will be kept indefinitely.
- Resolutions of discipline proceedings against members or former members may be published and kept indefinitely on the public section of the website, in accordance with the terms of the resolution agreed to between the member or former member and the Institute.
- Tribunal decisions involving members or former members whose membership was cancelled or who have resigned will generally be kept on the public section of the website indefinitely.
- Tribunal decisions involving members who have been suspended will generally be kept on the public section of the website until the member has been reinstated and for approximately two years thereafter, at which time the member's name will be removed from the summary of the decision, which will generally remain on the public section of the website indefinitely.
- All other Tribunal decisions will generally be kept on the public section of the website for approximately two years after completion of all proceedings and appeals, at which time the member's name will be removed from the summary of the decision, which will generally remain on the public section of the website indefinitely.
- Other public notices since September 12, 2013, not included elsewhere in the discipline summaries will generally be kept on the public section of the website indefinitely.
Discipline summaries that were posted on the members’ only section of the Institute’s website prior to December 31, 2007 continue to be maintained on the members’ only section of the website in accordance with the following general guidelines:
- PCEC determinations and recommendations, “resignations in the face of discipline”, and Tribunal decisions involving members or former members whose membership was cancelled or who have resigned will generally be kept on the members’ only section of the website indefinitely.
- Tribunal decisions involving members who have been suspended will generally be kept on the members’ only section of the website until the member has been reinstated and for approximately two years thereafter, at which time the member’s name will be removed from the summary of the decision, which will generally remain on the members’ only section of the website indefinitely.
- All other Tribunal decisions will generally be kept on the members’ only section of the website for approximately two years after completion of all proceedings and appeals, at which time the member’s name will be removed from the summary of the decision, which will generally remain on the members’ only section of the website indefinitely.
It should be noted that the Institute's Rules of Professional Conduct and Bylaws named in the discipline summaries may not necessarily agree with the numbers of the current Rules or Bylaws. Rule and Bylaw numbers quoted are those in effect at the time.
